Ohio Supreme Court Justice Jennifer Brunner filed a lawsuit Tuesday against state officials over a 2021 law that requires candidates for the high court and for appeals courts to run in the general election with a party affiliation on the ballot.

Ohio Supreme Court Justice Jennifer Brunner sued state officials over a law that requires candidates for the high court to run with party affiliations in general elections.CLEVELAND, Ohio— An Ohio Supreme Court justice on Tuesday sued state officials over a law that requires candidates for the state’s high court and for appeals courts to be listed on the ballot with party affiliations.

It also grouped the Supreme Court candidates on the ballot directly below statewide officer seekers and federal candidates, which are typically more partisan races, and separated them from appearing with other judicial candidates running in county or municipal elections, the lawsuit said. Other judicial candidates still run in the general election without party affiliation.

In 2022, the first election with partisan affiliation, Republicans won two seats on the Supreme Court that were up for grabs and Brunner lost to Sharon Kennedy in their bid to replace the retiring Maureen O’Connor as chief judge. Brunner is next up from election in 2026. The state’s high court is currently made up of four Republicans and three Democrats.
