Daniel Ray Caldwell doused a group of officers with bear spray during the Jan. 6 uprising at the U.S. Capitol, a prosecutor said.
U.S. District Judge Colleen Kollar-Kotelly in Washington D.C. issued the 68-month sentence on Thursday. Assistant U.S. Attorney James Peterson asked the judge for a 70-month sentence, saying Caldwell armed himself with bear spray and planned for violence. The officers who were pepper sprayed suffered injuries, Peterson said, including impaired vision, difficulty breathing, burned skin and severe skin irritation and pain.
“This showed a complete lack of respect for the role of police, in which officers were attempting to stymie further chaos on the scene,” Peterson said in the memo. Caldwell’s attorney, Robert Jenkins, said in a recent court filing that his client is the father of three children and a disabled veteran, not someone who is dangerous.
