Arrests among patients getting abortions will almost certainly over target women of color.

This is not to say that there is nothing that can be done at the state level . Even mayors who aren’t willing to promise not to arrest abortion providers can think more carefully about budgeting for police, or can at least consider how certainor data-retention policies may make arrests or prosecutions easier or harder. At the same time, cities are generally legally powerless against a state government set on gutting home-rule decisions.

Nothing here, however, should be read to mean that there is no hope—just that political time and energy need to be focused where they can have their biggest impact. It’s true that prosecutors have often been seen as the leaders in the push for reform, in part because their elections can focus attention on the faults in the criminal legal system, but also in part because of the power they have traditionally wielded.
