Even in 2000, when Al Gore called for a recount of the remarkably close Florida results that swung the election to George W. Bush, the certification process proceeded without any problems once the legal avenues for a recount had been exhausted. John Eastman, a member of Trump’s legal team, had written a two-page memo spelling out how he believed a presidential election could be overturned.
In this era of conspiracy-minded election deniers, we can expect more of these threats to the democratic process unless we clarify the law. It would make it more difficult for congressional troublemakers to block the certification by lodging an objection.
