This was when things got tricky. The carbon-dioxide emissions of a vehicle with an engine are directly proportional to the fuel it burns. In other words, decreasing carbon dioxide meant increasing fuel efficiency. In 2007, the Supreme Court ruled that the Clean Air Act not only allowed the EPA to regulate carbon-dioxide emissions but actually required it to do so. Despite this, the George W. Bush administration spent the rest of its tenure slow-walking any rule changes by the EPA.
The Trump administration threw a curveball at CARB when it attempted to quash the so-called California waiver that allows the state with the largest economy in the U.S. to enact its own emission rules. In response, a group of automakers—BMW, Ford, Honda, and the Volkswagen Group—cut a side deal with CARB in July 2019; Volvo joined in August 2020.
