woman who died in September has filed a wrongful death lawsuit against the municipality and the construction company doing work along Washington Road, alleging that her death was caused by injuries she suffered months earlier when she tripped on an oversized traffic cone.
Coester fell and suffered numerous injuries to her head and face, and she had to be hospitalized, according to the lawsuit filed by her son. Those injuries in turn caused “significant weakness and immobility,” which caused fatal pulmonary embolisms, the lawsuit alleged. The lawsuit names the town, Plavchak Construction, the contractor on the project, and Gateway Engineers, the engineering consultant. The $3.9 million project has been in the works for several years. A spokeswoman for the town declined comment, citing the pending litigation. Neither Plavchak nor Gateway could immediately be reached for comment.
Those hazards, the lawsuit claims, were “reasonably foreseeable” and the conditions caused by the construction had already been the subject of complaints.
