A recent decision by the Saskatchewan Court of Appeal found a new trial must be ordered for men convicted of unlawfully hunting and fishing.

“We shouldn’t be carving up our our nation in terms of rights, because we are highly mobile people, moving with the buffalo hunt, the fur trade,” said the lawyer, who noted he doesn’t practice “per se,” but began taking on legal work relating to Métis rights at the insistence of his elders in 1993.Article content

And while the May 31 Court of Appeal decision did not further define where Section 35 rights can be exercised by Métis people, it did find that further argument could be made on the subject — argument that the trial judge did not consider.

“This Court, however, is not in a position to make the findings of fact necessary to determine the validity of such a claim, which means a new trial must be ordered,” the decision reads.
