SAN JOSE — A former San Jose police officer stands to receive a $400,000 payout from the city to settle a lawsuit alleging he was the target of steady Islamophobic harassment from this colleagues, a claim the city argued was a mischaracterization of off-color banter that he himself took part in.

Nabil Haidar, a Muslim-American officer with the San Jose Police Department filed claims against San Jose and the San Jose Police Department for alleged continuous harassment and discrimination based on his race, national origin and religion on Monday, May 7, 2018. Friday, goes before the city council for approval Sept. 26. As part of its terms, the city admits no fault or liability for Nabil Haidar’s claims.

Haidar’s attorneys declined to comment on the proposed settlement, citing that it has not been finalized. The City Attorney’s Office did not immediately respond to a request for comment Friday. Filings from the city argued that Haidar was a willing participant in the boorish talk that included the insults he claimed in the lawsuit. That included him allegedly responding to the “ISIS” comments by making a crude remark about the sergeant’s wife and joking about his Italian background.
