A Richmond police officer has been fired and charged with felony assault in connection with an April incident where he allegedly struck a man 38 times with his stun gun.

, along with enhancements for allegedly causing great bodily injury and being on duty at the time of the incident. The alleged victim, a 33-year-old man, required several staples on his injuries from the incident.

The 33-year-old man was suspected of evading police during an earlier brief car chase, in Richmond. Smith spotted the man in a parking lot and stopped him. He later wrote in a report he believed the man was armed and was resisting arrest, but no gun was ever found. “Officer Smith’s actions are unacceptable. His behavior deviated from our training and will not be tolerated,” French said.

Smith’s attorney, Harry Stern, issued a public statement saying it was “entirely reasonable for Smith to believe the man had a firearm.
