David Gonzales crashed around 3 a.m. the morning after his 36th birthday, police said.

FAIRFIELD — An off-duty Oakland officer was arrested on two counts of drunken driving after he allegedly crashed his car into a California Highway Patrol vehicle that was stopped on the freeway, injuring an officer, authorities said.

David Gonzales was arrested 3 a.m. Saturday — the morning after his 36th birthday — east of the Manuel Campos Parkway exit on Interstate 80 in Fairfield. He was booked into Solano County Jail on two felony charges of DUI causing injury, which each carry a $25,000 bail, according to the jail’s intake log.

Gonzales is no longer in custody, according to jail records. Solano County prosecutors have not yet reviewed the case against him and decide whether to file charges.Crime and Public Safety |allegedly rear-ended the patrol vehicle. The patrol car was occupied with one officer who was hospitalized with non-life-threatening injuries. A second CHP officer was present and standing away from the vehicle at the time of the collision.

Gonzales stayed at the scene and cooperated, authorities said.
