COLUMBUS, Ohio -- A state law that shifted the burden of proof to prosecutors when criminal defendants claim self-defense began applying to all trials when the statute went into effect in March 2019 -- even when the crimes happened before then, the Ohio Supreme Court ruled Thursday morning.
The case before the Ohio Supreme Court originated out of Richland County. Ladasia Brooks and Dan Meyers had a 5-year-old child together when Meyers ended the relationship in May 2018. The two have conflicting accounts of what happened in June of that year. Brooks argued she had permission to be in the house to retrieve money to pay for their daughter’s birthday party. She said she walked through an open door and acted in self-defense against Meyers and his stepfather, who restrained and struck her.During the trial, the judge acknowledged that thehad changed between the date that the offenses occurred and the trial date.
While all the justices agreed that the burden of proof shifted in trials on March 27, 2019, the court was divided, 4-3, in legal reasoning. But Brunner wrote that under certain circumstances, the legislature could pass laws that affect procedural matters. Establishing who has the burden of proof in court is a procedural matter, she wrote., “No Bill of Attainder or ex post facto Law shall be passed.” That means laws cannot retroactively punish past criminal behavior.
