Indianapolis Mayor Joe Hogsett is calling on the Health & Hospital Corp. of Marion County to backtrack on, saying the agency’s sweeping request to ban private lawsuits over federal safety net programs was “a step too far.”

The city isn’t involved in the case, which started in 2019 when a family sued a Health & Hospital-owned nursing home over alleged federal rights violations. But, he said, “as mayor, I have a responsibility to make my position clear on a matter of such widespread significance.” “It is understandable that members of the public are concerned about the wide-ranging implications should the Supreme Court adopt this view,” Hogsett said.

Legal experts who oppose Health & Hospital's position, meanwhile, say narrowing the argument won't allay the danger for beneficiaries. "For the last 40 years, the Supreme Court has recognized that people have the right to enforce provisions of federal entitlement programs," Perkins said, in response to Hogsett's statement.

One bi-partisan group of former Congress members said the legal protections at risk are rooted in"arguably the most important civil rights statute in the history of the United States.”
