A judge has thrown out several claims but preserved others in a lawsuit filed by biologist David Sabatini against the Whitehead Institute and a scientist who accused him of sexual harassment.

The judge opined that that claim “appears to be weak” but Sabatini’s arguments “minimally state a claim” she would allow to proceed. She also found that Sabatini’s claim that Knouse discriminated by creating a hostile work environment for him with harassing text messages seeking to rekindle their relationship could proceed.
For instance, in his defamation claim against Knouse, Sabatini alleges that Knouse told Whitehead Institute colleagues he was a “rapist” and a “Harvey Weinstein,” referring to the Hollywood producer convicted of felony rape in 2020. The judge wrote that “statements that someone is a rapist, or a Harvey Weinstein–like abuser could be understood by the average person to be either a verifiable fact or a hyperbolic opinion, in which case the issue must be left to the jury’s determination.
