State Sen. Julie Gonzales and Reps. Serena Gonzales-Gutierrez and Jennifer Bacon are pushing to raise the minimum age for juvenile prosecutions in the state from 10 to 13 in all cases except when a child is suspected of homicide.

Just over 500 children ages 10, 11, and 12 were charged with crimes in Colorado’s juvenile courts last year — a number that a trio of Democratic lawmakers hopes to drop to zero.

Currently, children as young as 10 in Colorado can be charged with crimes and sentenced to juvenile detention. In 2019, prosecutors filed 789 delinquency cases against children who were 10, 11 or 12, according to data provided by the Colorado Judicial Department. That dropped to 589 in 2020 and to 506 in 2021.

But the proposed law change would apply to both minor and serious offenses, which some opponents took issue with. Boulder County District Attorney Michael Dougherty testified during a lengthy public hearing in February that the proposed changes would leave a hole that would be difficult to fill. All of the state’s 22 elected district attorneys oppose the bill as introduced, said Elizabeth Schrack, communications manager for the Colorado District Attorneys’ Council.
