House Bill 1488 would remove municipal elections from the language of the state’s election code as it applies to constitutional amendment referenda.

Pennsylvania House Democrats on Wednesday passed a bill through committee that would restrict constitutional amendment referenda to general election ballots only, a response to the recent rash of politically controversial constitutional questions.

The 2021 primary featured two constitutional ballot measures giving the legislature more control over the governor’s emergency powers, a topic of partisan contention after the referenda were initiated by a Republican majority who had fought against former Gov. Tom Wolf’s COVID-19 policies. Proposed changes to the state constitution must be passed by the legislature twice, in separate sessions, before they appear on the ballot at the next election that occurs at least three months after the second passage.

“We need to make sure that we are getting as close to an actual broad majority of voters in the commonwealth” to weigh in on constitutional changes by setting the standard that such referenda will only happen in general elections, Siegel continued.
