The future of a wildlife haven close to a Blackburn housing estate will be decided by a government inspector.

Landowners Dorbcrest Homes, who built the estate at Kingsley Close two decades ago, then inquired about planning permission to build houses on the ‘green lung’, which is home to wildlife including hares, deer, woodpeckers and birds of prey. No application was submitted after discussions with Blackburn with Darwen Council.

. The council issued an enforcement notice requiring the firm to maintain the land in a neat condition and allow unrestricted public access. Appearing for the landowners Mr J and Mrs G Boylan, barrister Anthony Gill said in his closing statement: “The appellants submit that it is clear that the site has never been public open space. It was never made available for public use.
