Adante Pointer, who is representing K’aun Green said that his client helped stop a shooting from happening inside La Victoria restaurant Sunday and was backing out of the restaurant when responding police opened fire.
“The police yelled ‘drop the gun,’ and without giving my client a second to understand it was the police, or turn around and see what was going on, or even drop the gun, he was shot multiple times,”Pointer said Green was “minding his own business,” when the fight broke out and that he did not know the participants.
San Jose Police Chief Anthony Mata reportedly said his department has learned that the gun was not Green’s, but he said that Green did not respond to repeated orders to drop the weapon before he officers fired. Mata said that a homicide scene had also occurred about a block away from where the incident unfolded and that police believed an “active shooter” situation might have been taking place.
