Also, emergency personnel failed to “swiftly and properly respond” to Vasquez, “a swimmer who required rescue,” the suit states. Vazquez “was a person of diminished mental capacity, incapable of understanding the nature and consequences of personal actions,” the suit says. Although he was age 17, he had the mentality of a younger person, according to the lawsuit.
