But nearly five years later, a judge tossed out the DNA sample in the case, saying it can't be used as evidence because it was collected as part of an unrelated case.The decision came as a surprise to Feldman's family. The Maricopa County Attorney's office appealed that ruling and was able to argue their case on Wednesday.
