and similar drugs, which campaigners have blamed for babies being born with life-changing malformations such as limb defects, congenital heart defects, brain damage and developmental difficulties.Campaigners say Primodos was 40 times the strength of an oral contraceptive. Despite warnings and concern, it was not until 1978 that it was taken off the market.

The campaigners sought to sue Bayer Pharma, Schering Health Care, Aventis Pharma and the Government in a bid for compensation. The drug companies made a bid to have the claim thrown out.Handing down the judgement, Mrs Justice Yip said on Friday: “I recognise the profound disappointment my judgement will bring for the claimants.

“They believe, and will no doubt continue to believe, that HPTs [hormone pregnancy tests] were the cause of the birth defects and the loss of the babies which they have suffered. No one has been able to confirm definitively that this belief is wrong. She added: “I have approached this litigation with sympathy for the claimants. I maintain that approach in taking this decision but I am driven to the conclusion that the only appropriate action is to strike the claims out.”
