to an arraignment Thursday in Fort Worth to hear from a dozen relatives of those killed in two 737 Max Jet crashes. The ruling threatens to unravel Boeing’s plea deal with U.S. prosecutors that shields the company from prosecution and criminal liability.

Boeing said in November that it opposes any effort to reopen the agreement, calling it “unprecedented, unworkable and inequitable,” and noted it has been complying with the agreement for nearly two years. Dave Calhoun, Boeing’s chief executive officer, said Wednesday on CNBC that while he’s not qualified to speak on the legal aspect of Thursday’s hearing, his thoughts regarding affected families remain the same.

The ruling came after family members of the crash victims accused the Justice Department of failing to abide by the federalwhich they say requires prosecutors to seek input from victims when seeking plea and deferred prosecution deals. Federal prosecutors argued that the law didn’t apply to them because they couldn’t prove that those who died in the 737 Max crashes were crime victims.
