Bexar DA joins four others to say: We won’t prosecute women seeking abortions

Gonzales has joined several other DAs in stating they won’t prosecute women who seek abortions, reiterating that the state law banning the procedure makes it a civil, not a criminal matter.
In a statement released Tuesday, he said he stood with Starr County District Attorney Gocha Allen Ramirez, who obtained the dismissal of a murder charge against Lizelle Herrera after she was indicted on the first-degree felony for ending her pregnancy and spent three days in jail. “No woman should be punished for making a personal medical decision,” Gonzales said. “No health care provider should feel a responsibility to report these women seeking care to law enforcement. In this case, a dismissal was the right thing to do but she should not have been subjected to being arrested and incarcerated for exercising her very personal health care decision in the first place.”
The letter also was signed by district attorneys John Creuzot of Dallas County; José Garza of Travis County; Mark Gonzalez of Nueces County; and Brian Middleton of Fort Bend County.A Texas law that went into effect in September prohibits abortions after six weeks of pregnancy and allows any citizen to file a civil lawsuit against the provider and any person who helps a woman obtain one.
