“I think we all agree, we shouldn't just permit anything everywhere all the time. Even in the absence of zoning. So what tools are we left with to cooperatively work with developers to get the right results?” asked Haymon. “The tools are these ordinances that were hard-fought by some of these same residents and that have really benefited a lot of people, not just in our area, but around the city.
Without offering developers certainty, planning and financing a project would become nearly impossible, experts say, perhaps stopping new development before it started. Councilmember Abbie Kamin, whose district includes Boulevard Oaks, has repeatedly raised concerns about the effects of grandfathering on Houston’s development policies and says she’s studying what can be done about the law.
“2007 was almost a quarter of a century ago. Things change,” said Mack Fowler, another Boulevard Oaks resident. He and other neighbors argue that the Langley couldn't be built under current buffering rules.But StreetLights, and likely other developers, would argue that grandfathering isn’t a loophole but rather a state law needed to provide regulatory certainty.
