The exchange took place during a hearing on the state’s appeal of a lower court ruling that sided with prosecutors and put an abrupt hold on the state’s plan to end cash bail. The state Supreme Court stepped in hours before the measures were to take effect on New Year’s Day, halting implementation until it rules on the matter.
Justice Joy Cunningham cut to the heart of the issue, asking Rowe: “What’s the purpose of setting monetary bail as you see it?”
